This document sets out the Terms and Conditions you need to be aware of when using this website. Please take a moment to read them, as they set out your important rights and obligations and The Wellness Nest cares about making sure we both know where we stand. When you visit this website, our services or purchase our products you agree that you are over the age of 18 and willing to be bound by these Terms and Conditions. If you don’t accept this agreement, you should not continue to visit this website, come in for a treatment or purchase from us.

This disclaimer relates to our Myotherapy and Senior Myotherapy services. Our intention in supplying this service is to provide the highest quality physical therapy with a holistic approach that is tailored to your individual needs. 

OUR RESPONSIBILITY

Our responsibility as Myotherapists is provide you with the highest quality myotherapy care. This means that it is our responsibility to follow our associations guidelines and requirements to practice myotherapy in Australia. It is imperative that we consider your health history whilst completing a thorough subjective and objective assessment. We must then discuss with you our treatment plan in full detail and gain your consent before proceeding with any treatment. It is our decision to terminate a session if we feel the need too. At The Wellness Nest all Myotherapists have a Bachelor of Health Science degree or Advanced Diploma of Myotherapy qualification to provide you with the highest quality of care. It is our responsibility to inform you, the client of any adverse responses, the risks involved in any treatment modality used and any side effects that may occur. As Myotherapists we are to tell you immediately if your treatment session needs to be altered or if your treatment plan initially discussed also needs to be altered, this must be agreed upon by you. 

YOUR RESPONSIBILITY

Your responsibility is to ensure that you inform your practitioner of your current and past health history. It is your responsibility to inform them of any changes that occur no matter how minor you might think it is at any appointment you have with any team member of The Wellness Nest. You must do this at any appointment and at any stage to ensure the practitioner can give you the safest and best treatment plan possible. It is your responsibility to partake in the treatment plan and any homecare strategies given to you by your practitioner. You understand that failure to do so will impact the outcome of your treatment goals. You have the responsibility to ask questions and seek clarification from your practitioner if you do not understand anything you have been told. If you consent to the treatment and any modality used you have accepted the risks, potential adverse responses and any procedural information that goes with it. You have the responsibility to terminate the treatment at any stage, the responsibility to decline any amendments to your treatment plans or to say you are uncomfortable at any stage.

It is your responsibility to follow our 48-hour cancellation policy and in the event you cancel or reschedule within this period you understand that you forfeit your $35 deposit.

PROBLEMS

If any concerns should arise you should seek advice from a medical professional prior to your myotherapy consult.

SUITABILITY

This product is suitable for the majority of individuals who are wishing to prevent, maintain or treat any acute or chronic musculoskeletal pain or discomfort. In the event your myotherapist is concerned that the treatment may not be suitable or are concerned, they will refer you to your general practitioner or a suitable health professional.

TRADEMARKS

The Wellness Nest own the unregistered trademarks in The Wellness Nest and logo as seen on this website. You may not use these marks for any purpose without our express permission.

Payment Terms

FORMS OF PAYMENT

Any form of treatment received from The Wellness Nest must be paid in full at the time of your consultation. You can pay via EFTPOS, Visa or Mastercard and/or cash if you please. A HICAPS machine is available on site and we can swipe your private health insurance card at the time of consultation. You are required to cover the gap or entire consultation if required. 

PAYMENT PLANS

At The Wellness Nest we do not offer payment plans. 

Returns Policy

The below returns policy is applicable to all Myotherapy and Senior Myotherapy sessions. 

ORDER FULFILMENT POLICY

At The Wellness Nest, we understand that sometimes, you may need to cancel or reschedule an appointment. We appreciate as much notice as possible if you need to change your appointment. You can cancel or reschedule your appointment by calling us directly or contacting us via text.

Please note that our cancellation policy is strictly 48 hours for all clients. If you fail to give 48 hours’ notice of your appointment you will be invoiced for the full consultation fee and be expected to pay this within 3 days of the invoice date.  The invoice will be sent via email and bank transfer will be the method of payment.

Running late for your appointment? To ensure punctual service for all clients, appointments that start late due to client tardiness will unfortunately finish at their scheduled time, resulting in a shorter appointment for you.

It is your responsibility to ensure you have selected the correct consultation and cost for your needs and to abide by our cancellation policy.

CHANGE OF MIND

We do not offer a refund to clients who change their mind.

Consumer Guarantees

MINOR PROBLEM

In the event that your consultation cannot be fulfilled due to your practitioner being ill etc. you will be notified as soon as possible by call, text and/or email. Your appointment will be rescheduled as soon as possible and suitable for you. The Wellness Nest cancellation policy is not applicable in this event. 

MAJOR PROBLEM

In the event a major problem occurs or you feel your treatment or anything related to the service has not been met you have the right to:

 - cancel the contract and demand a refund 

- seek compensation for the difference between the price paid and the services actually provided

If you feel this is the case please contact Rhianna (rhianna@thewellnessnest.com.au) within 7 days of your treatment date and outline your concerns.

As a client of The Wellness Nest you are NOT entitled to a remedy if you have been provided the goods or services with proper care and skill but something outside human control has intervened to cause the problem.

If the practitioners working under the brand The Wellness Nest have fulfilled their requirements and followed all procedures as per their degree’s/qualifications and you have not received any change in your symptoms, you are not entitled to a refund. In this event a one on one consult with senior myotherapist and founder Rhianna will be held to address your concerns. 

In the event you believe any practitioner has not followed any code of ethics as a health professional, please contact Rhianna immediately and/or the myotherapy associations. 

Visitor Information

RESPECTFUL COMMUNICATION

If you comment on our blogs or any other media it must be done in respectful and constructive manner. In the event that unacceptable comments are made because they are rude, offensive or for any other reason these comments will be removed. 

THIRD PARTY CONTENT

Any information supplied by affiliates, collaborators or joint venture relationships are the opinions and advice of the respective party and are not those of any practitioner of The Wellness Nest. 

Jurisdiction & Dispute Resolution

JURISDICTION

The Wellness Nest is located in Victoria. This agreement is subject to the governing law of Victoria.

NEGOTIATION

If you have any issue or complaint arising out of your use of this website or these terms and conditions, you and The Wellness Nest agree to make a genuine effort to resolve the dispute through negotiation and discussion

MEDIATION

If we are unable to resolve a dispute by negotiation and discussion within 14 days, the parties must proceed to mediation with the assistance of an accredited mediator who is independent of the parties. The mediator is to be appointed by agreement of the parties or, failing agreement within twenty-one (21) days of the first notification of the dispute, by a person appointed by the Chair of Resolution Institute, (ACN 008 651 232, Level 2, 13-15 Bridge Street, Sydney NSW 2000; telephone: 02 9251 3366, email: infoaus@resolution.institute) or the Chair’s designated representative. The Resolution Institute Mediation Rules shall apply to the mediation. We agree to share the costs of mediation equally between us.

LITIGATION

It is a condition precedent to the right of either party to commence litigation other than for interlocutory relief that it has first offered to submit the dispute to mediation. Litigation is to be considered a last resort and may not be commenced until, in the opinion of the independent mediator, the potential for negotiation and mediation have been exhausted
